Right to interpreter upheld

Strasbourg, France (European Court of Human Rights): In the Özden v. Turkey case, the applicant was arrested on suspicion of being a member of the PKK (Workers’ Party of Kurdistan), tried and sentenced to three years and nine months’ imprisonment.
The applicant submitted that his defence rights had been infringed as he had not had the assistance of a lawyer or an interpreter throughout the trial. He relied on Article 6 §§ 1 (right to a fair hearing) and 3 (c) (right to legal assistance) and (e) (right to assistance of an interpreter).
The Court held unanimously that there had been a violation of Article 6 § 1, and awarded the applicant EUR 1,500 for costs and expenses.
